สำนักงานคณะกรรมการกฤษฎีกาได้เสนอร่างพระราชบัญญัติว่าด้วยการดำเนินงานขององค์กรที่ไม่แสวงหารายได้หรือกำไรมาแบ่งปันกัน และเพิ่งได้ผ่านพ้นช่วงรับฟังความคิดเห็นของประชาชนบนหน้าเว็บไซต์ของสำนักงานฯ นอกจากนี้ ยังมีร่างพระราชบัญญัติส่งเสริมและพัฒนาองค์กรภาคประชาสังคมของกระทรวงการพัฒนาสังคมและความมั่นคงมนุษย์ ซึ่งกำลังอยู่ในขั้นตอนการพิจารณา ร่างกฎหมายทั้งสองฉบับนี้ต่างมีผลกระทบต่อภาคประชาสังคมและองค์กรไม่แสวงหากำไรนอกภาครัฐ (NGOs) รวมไปถึงการดำเนินงานของกลุ่มองค์กรดังกล่าวในประเทศไทย ด้วยเหตุนี้องค์กร NGOs ทั้งระดับชาติและระหว่างประเทศจำนวนหนึ่งได้ยื่นข้อวิจารณ์ เพื่อเป็นข้อมูลประกอบการพิจารณาข้อกฎหมาย โดยมุ่งหวังว่าภาคประชาสังคมจะยังคงสามารถแสดงบทบาทอันสำคัญในการส่งเสริมการพัฒนาที่ครอบคลุมและเป็นธรรม รวมถึงการสนับสนุนความเป็นอยู่ของภาคส่วนที่มีความเปราะบางมากที่สุดในสังคม ร่าง พ.ร.บ. ฉบับแรกที่กล่าวถึงข้างต้นได้รับความสนใจและเป็นที่ถกเถียงกันในวงกว้าง เนื่องจากมีการนิยามความหมายอันกว้างขององค์กรไม่แสวงกำไร อีกทั้งมีเงื่อนไขที่จะส่งผลกระทบอย่างมากต่อภาคประชาสังคม ตามที่ได้ร่างไว้ในขณะนี้ พ.ร.บ.ดังกล่าวได้ครอบคลุมถึงเรื่องการบังคับการจดแจ้งต่อกรมการปกครอง กระทรวงมหาดไทย (ความผิดต้องระวางโทษจำคุกสูงสุดไม่เกินหกปี และ/หรือ ปรับไม่เกินหนึ่งแสนบาท), การรับเงินทุนจากต่างชาติมาใช้ดำเนินกิจกรรมจะใช้ได้เฉพาะกิจกรรมที่รัฐมนตรีกำหนดเท่านั้น, ผู้รับจดแจ้งการดำเนินงานมีอำนาจเข้าไปในสถานประกอบการ รวมทั้งมีอำนาจตรวจสอบและทำสำเนาข้อมูลจราจรทางอิเล็กทรอนิกส์ขององค์กรได้ด้วย นอกจากนี้ยังมีข้อบังคับอันล่วงล้ำสิทธิ์ให้มีการตรวจสอบและให้รายงานการดำเนินการใช้จ่ายเงินและการดำเนินกิจกรรมอย่างเคร่งครัดมากยิ่งขึ้น เพื่อที่จะทำความเข้าใจรายละเอียดของร่างพ.ร.บ.ทั้งสองฉบับให้มากยิ่งขึ้น พร้อมทั้งเปิดพื้นที่ในการสะท้อนข้อคิดเห็นเรื่องการสร้าง(หรือทำลาย)สภาพแวดล้อมที่เอื้ออำนวยต่อการทำงานของภาคประชาสังคม หลังจากที่ได้จัดงานเสวนาในภาษาอังกฤษ “Regulating – or Ruling – Civil Society in Thailand?” ไปแล้วเมื่อต้นเดือนเมษายนที่ผ่านมา งานเสวนาอภิปรายเรื่อง “การควบคุม (หรือครอบงำ) ภาคประชาสังคมในไทย?” จะจัดขึ้นในวันที่ 22 เมษายน 2564 เวลา 17.30 น. ที่ SEA Junction ชั้น 4 หอศิลปกรุงเทพฯ โดยจะสรุปภาพรวมของร่างพ.ร.บ.ดังกล่าว และผลกระทบที่อาจเกิดขึ้นต่อพื้นที่ประชาสังคม (จัดในภาษาไทย) ร่วมอภิปรายโดย: สัณหวรรณ ศรีสด,ที่ปรึกษากฎหมายคณะกรรมการนักนิติศาสตร์สากล (ICJ) Phil Robertson, รองผู้อำนวยการสำนักงานเอเชีย Human Rights Watch สุนทรี หัตถี เซ่งกิ่ง, กรรมการประสานงานองค์กรพัฒนาเอกชน (กป.อพช.) นาดา ไชยจิตต์, ที่ปรึกษาการรณรงค์สิทธิมนุษยชน…
